Regulations on social consumption of cannabis clicked into place last month, but regulators say that doesn’t mean a cafe will pop up in your community tomorrow.

Is social consumption legal?

Massachusetts voters approved social consumption of cannabis back in 2016, only for the initiative to remain effectively stagnant for a decade. That finally changed in December, when the Cannabis Control Commission ratified statewide regulations on social consumption – after 10 years of stagnation, social consumption finally has a tangible future in the Bay State.

However, many more pieces must fall into place before cannabis can mix with the downward dog at yoga. Municipalities must approve social consumption before issuing licenses. Commissioner Kimberly Roy estimates physical locations may not open for another year.

What happened in December?

In December, the Massachusetts Cannabis Control Commission ratified new social consumption regulations that will allow municipalities to issue licenses to qualifying establishments once the Commission opens its application portal.

“This is a new world, if you will, in Massachusetts,” Cannabis Control Commissioner Kimberly Roy said. “Massachusetts is the first state in New England to approve a social consumption license type, so it’s highly unique to the immediate region.”

When will social consumption options appear?

The approval of social consumption regulations does not mean cannabis cafes will suddenly begin popping up across the state over the first few months of 2026. According to Roy, the Commission has four internal working groups to prepare for the eventual rollout.

“I would say probably close to a year before we see this license type become a reality,” Cannabis Control Commissioner Kimberly Roy said.

What role do municipalities play?

Even after the Commission begins fielding applications, licenses may not necessarily be available statewide. Municipalities must individually opt-in to social consumption before assigning licenses to local establishments.

“My understanding is it’s all going to come down to local control,” Roy said. “So in some form, [social consumption] will need the blessing of the community, whether an ordinance, a bylaw or a referendum.”

How does the state license social consumption?

The Commission specifies three distinct social consumption license types: supplemental, hospitality and event organizer. According to Roy, municipalities may apply for up to three licenses per type for an aggregate total of nine licenses per community.

What are the three license types?

The supplemental category refers to an equity license that permits qualifying retail dispensaries to offer on-site consumption at their brick-and-mortar location. According to Roy, supplemental licenses require a host community agreement between the applicant and their local municipality.

Hospitality licenses, she said, allow new or non-cannabis businesses to partner with qualifying establishments to host cannabis consumption activities.

Lastly, the event organizer license allows qualifying applicants and retail dispensaries to host temporary cannabis consumption events in communities that opt-in to social consumption. According to Roy, event organizer licenses are valid for 30 days, and may only be used once per year in any given community.
