Subject: Manufacturing of Hand Sanitizer During COVID-19 (“Coronavirus”) State of Emergency

On March 10, 2020, Governor Charlie Baker declared a State of Emergency (“Order”) in the Commonwealth of Massachusetts due to the outbreak of the 2019 novel Coronavirus (“COVID-19”). On March 23, 2020, the Department of Public Health (DPH) announced a further order permitting Massachusetts Marijuana Product Manufacturers and Medical Marijuana Treatment Centers (MTC) licensed by the Cannabis Control Commission (Commission) to perform non-sterile compounding of alcohol-based hand sanitizers. The Commission is providing this bulletin to all Massachusetts Marijuana Product Manufacturers and MTCs for information and assistance. This bulletin supplements and updates the Commission’s bulletins issued March 23, 2020, March 20, 2020, March 18, 2020, and March 13, 2020.

Marijuana Product Manufacturers and MTCs licensed by the Commission may manufacture hand sanitizers in accordance with the DPH order and in compliance with Food and Drug Administration’s guidance and the World Health Organization’s Guide to Local Production. To the extent that Marijuana Product Manufacturers and MTCs may have concerns about compliance with these requirements, they are encouraged to consult DPH and/or the Board of Registration in Pharmacy.

The Commission recommends that any Marijuana Product Manufacturers and MTCs utilize video or telephonic consultation to engage a licensed pharmacist or, should on-site consultation be required, review and comply with the Commission’s regulations relative to visitors.
