Reminder | Licensee Power Outage Obligations | August 20, 2021
To: Marijuana Establishments and Medical Marijuana Treatment Centers
Subject: Licensee Power Outage Obligations
Date: August 20, 2021
Due to the severe weather anticipated in the Commonwealth in the coming days, the Cannabis Control Commission (“Commission”) is reminding all Marijuana Establishments and Medical Marijuana Treatment Centers (“Licensees”) of their obligations during a power outage.
Pursuant to 935 CMR 500.110(1) and 935 CMR 501.110(1), 935 CMR 500.110(5)(a)(8) and 935 CMR 501.110(5)(a)(8), 935 CMR 500.110(6)(a)(8) and 935 CMR 501.110(6)(a)(8), Licensees may remain operational during a power outage for a minimum of four (4) hours. If it appears that an outage will last longer than that, Licensees must take sufficient steps to ensure continuous operation of the primary security on the premises. Such additional measures may include, but are not limited to, an uninterruptible power supply or a generator that will provide power to the security infrastructure.
Licensees are encouraged to submit questions about this reminder to their assigned investigator or compliance officer, or to Inspections@CCCMass.com.
