Notice of Public Comment | 9/28/20 – 10/15/20
Notice is hereby given pursuant to M.G.L. c. 30A, § 2, that the Cannabis Control Commission (Commission) will hold an additional public comment period limited to changes made to the regulations pertaining to delivery licenses set forth in 935 CMR 500.000: Adult Use of Marijuana.
The Commission promulgates the draft regulations pursuant to its authority under M.G.L. c. 94G, Regulation of the Use and Distribution of Marijuana Not Medically Prescribed; and M.G.L. c. 94I, Medical Use of Marijuana. In compliance with the requirements of the Massachusetts Secretary of State’s Regulations and Publications Division, the Commission received public comment between July 24, 2020, and August 14, 2020, on changes to 935 CMR 500.000: Adult Use of Marijuana, 935 CMR 501.000: Medical Use of Marijuana, and 935 CMR 502.000: Colocated Adult-Use and Medical-Use Marijuana Operations.
As a result of receiving public comment on the regulations pertaining to delivery licenses 935 CMR 500.000: Adult Use of Marijuana, additional changes were made to the applicable regulations. To provide the public with the opportunity to comment on these changes, the Commission will post the revised draft and seek written comment until the end of business October 15, 2020. Please restrict your comment to the regulations pertaining to delivery; comment on any other part of the regulations will not be considered.
Public comment.
The Commission will accept comments via mail and email. Please submit written comment electronically to the following address: Commission@cccmass.com. It can be submitted as an attached Word document or as text within the body of an email. Please note in the subject line “Draft Delivery Regulations”. All submissions should include the submitters’ full name, city/town and state, and if available, electronic mail address and phone number.
Please identify the section of the regulations to which the submitted comments refer and if possible, the following information:
- If the request is to amend the draft regulation, a copy of the regulation with changes clearly marked on electronic or paper copies; and
- The reasons for the request including, but not limited to, citation to any relevant legal authority, arguments and evidence, including data, that supports the request.
If interested parties are unable to submit electronic public comment, they should mail written submissions to the Commission at this address: Cannabis Control Commission, ATTN: DIRECTOR OF CONSTITUENT SERVICES, 2 Washington Square, Worcester, MA 01604. Because the Commission’s offices are closed due to the COVID-19 state of emergency, for the Commission to receive submissions by mail, we recommend sending the submission via the US Postal Service without requiring a signature..
All public comment should be submitted as soon as possible, and not later than 5:00 p.m. on October 15, 2020. Any submissions received after that date will not be considered as timely and may not be reviewed. In the interest of transparency, the Commission may publish the submissions it receives on its website or produce these submissions in response to a request made under the Massachusetts Public Records Law, M.G.L. c. 66, § 10, or other compulsory legal process.
